BEGINNING JANUARY 1, 2012, AG RETAILERS WILL BE FORCED BY STATE LAW TO START CHARGING SALES TAX ON ALL PURCHASES TO THOSE GROWERS WHO HAVE NOT OBTAINED A TEXAS AGRICULTURAL AND TIMBER EXEMPTION REGISTRATION NUMBER FROM THE STATE OF TEXAS, AND PROVIDED THE RETAILER WITH A SIGNED TEXAS AGRICULTURAL SALES AND USE TAX EXEMPTION CERTIFICATION. IT IS THE GROWER'S RESPONSIBILITY TO FILE FOR THE REGISTRATION NUMBER AND PROVIDE US WITH THE TAX EXEMPTION CERTIFICATION.
STEP 1 You must obtain a Texas Agricultural and Timber Exemption Registration Number by going online to www.getreadytexas.org. Follow the instructions on the site to obtain your number. You may also call the Comptroller's Fax on Demand service at 1‐800‐531‐1441, to have an application faxed to you, or call 1‐800‐252‐5555 to request that a copy of the application be mailed to you.
STEP 2 Fill out a Texas Agricultural Sales and Use Tax Exemption Certification and make sure to put your tax exempt number in the proper box and sign it. We will be required to have this certification for each customer/entity in our files by January 1, 2012 in order to exempt our production ag customers. We will be glad to provide you with copies of this form at Nix Implement Co., Inc.
If you have any questions concerning the new requirement, please contact the State of Texas Comptroller's Office at 1‐800‐252‐5555. We also encourage you to contact your state elected officials concerning the threat of taxation to the farmers of Texas.
